Thank you for selecting Spark Digital to provide telecommunications and/or ICT (Information Communications Technology) services for your business. We are pleased to offer you services on the terms and conditions and at the rates set out on the previous webpage (the “Your recommended plan” page)
For a clear understanding of the services, fees and terms of the Agreement you are entering into with us, please ensure that you read the entire Agreement.
1. Parties
This Agreement is between Spark Digital, a division of Spark New Zealand Trading Limited (“Spark Digital”, “we”, “us” or “our”) and yourself (“you”, “your” or the “customer”).
2. General Terms
The Spark Digital General Terms form part of our Agreement with you. These terms detail things such as the circumstances in which services could be suspended or restricted, cancellation charges, the altering of terms, use of personal information and limitations or exclusions of liability, as well as explaining what we can do for you if any problem arises.

3. Term and Termination
This Agreement will commence on the date you click the “Automatically update my plan now” link and will continue for 24 months (the “Initial Term”).
Notwithstanding clause 14.1 of the General Terms, you acknowledge and agree that Spark Digital may terminate this Agreement in whole or in part on one months written notice if the Spark Digital Business Agreement between Spark Digital and your Head Office is terminated.
4. Fees and Services
The fees for the Business Flex Services are specified on the previous webpage ( the “Your recommended plan” page). Unless otherwise specified, all prices exclude GST.
The fees for the Business Flex services will apply to your individual account for as long as you remain an Affiliate or business owner connecting to the Spark Mobile Network for the predominant purpose of conducting your Head Office’s business, and approved by your Head Office as qualifying for the special pricing.
These special rates will be reviewed as soon as you cease to be an Affiliate of your Head Office, however, all other terms and conditions will continue to apply.
If the agreement between Spark Digital and your Head Office ends or is varied, or pricing is reviewed, the special pricing provided to you may be reviewed.
5. Confidentiality
As part of this Agreement, you are required to treat any commercially sensitive information as confidential. This includes the terms and conditions of this Agreement, as well as any information about pricing. Confidential information may only be disclosed with Spark Digital’s prior written consent or as required by law.
6. Acknowledgement
When you click the “Automatically update my plan now” link you are acknowledging and accepting that:
- This Agreement replaces any existing agreements you may already have with us for the Services; and
- You will be bound by the terms of this Agreement, including Spark Digital’s General Terms and you understand that other terms may also apply to the services we provide.
