1. An overage fee of $0.60/minute will apply to all National calls made outside of monthly plan allocations.
2. Data Stretch charges work as follows:
    
   Plans $120.85 per month and below: Data used after the plan allocation will be charged @ $0.25 per MB up to $20 (80MB), then the charging will be capped until 1GB of usage. This charging is repeated once more for a total of 2GB @ $40. Any additional data over 2GB will be charged @ $0.25 per MB.
    
   Plans $250.85 per month and above: Data used after the plan allocation will be charged @ $0.25 per MB up to $40 (160MB), then the charging will be capped until 2GB of usage. This charging is repeated three times for a total of 8GB @ $160. Any additional data over 8GB will be charged @ $0.25 per MB.
    
   Data stretch is included in the Lead plan only, any sharers on that leader will have their additional usage included in the data stretch applicable to that plan.

4. Only need data? Tablet sharers are available at $8.69 per month to share data from the pool. Casual voice charges apply.

The Data Pool includes an amount of data per month, and as you use more data the pool will automatically grow with additional Data blocks. If you don’t use all of your additional data you don’t lose it - it is available the following month. There is no limit to the number of additional blocks that can be applied, so you no longer have to worry about casual rates for data. Plus, you can stay in control with Data caps and individual data limits.

Notes:

1. For all data plans 1GB = 1024MB
2. An overage fee (per MB) of $0.20 may be charged for each MB in excess of a Tier’s usage range.
3. For monthly usage over and above 1GB and up to 8GBs, your overage fees for each connection shall be calculated as the lower of the following:
   1. the applicable Tier Fee that relates to your usage range for the given month; or
   2. the preceding Tier’s fee plus an overage charge of $0.20 per MB for any additional MB which is in excess of said Tier’s usage range.
4. Where a given month’s usage has exceeded 8GB, your overage fee shall be calculated as the following:
1. The Tier 4 fee plus an overage charge of $0.20 per MB for any additional MB which is in excess of 8GB.
5. Any Data connections which opt to receive a subsidy will be subject to a minimum 24 month connection term, commencing from the date of first receiving the subsidy.
6. Subsidy offerings are only compatible with connections receiving SmartBusiness Data rates and cannot be used in conjunction with any other Spark Digital Mobile plans.

The following rates apply for international calling in addition to any allowance included in your plan.

Notes:

1. Unless otherwise specified in your Service Schedule, mobile calling, text and data usage are charged at the applicable Spark rate located at www.spark.co.nz/mobile
2. Mobile to Mobile calls between any devices contracted under your customer number are not deducted from your monthly allocated Minutes. Please speak to your Client Manager for further detail regarding your customer number.
3. Calls made to Australia in excess of any monthly plan allocations and all other international calls will be charged the relevant International Calling rates.
4. For each Mobile Phone connected to a Spark Mobile plan a one minute minimum deduction from your Monthly Plan Allocation will be made for every call you make. After the first minute deductions will be on a per-minute basis. However if you make:
   
   1. An operator assisted call, you pay the full minute rate for each minute of part minute.
5. Every call you make is charged at the rate that applies at the start of the call, including calls answered by the called party’s cellular secretary, voicemail or messaging service. If the number is busy or there is no answer you will not be charged for the call.
6. For voice calls made using data devices the applicable rate for voice calls is the casual voice plan. For more information go to www.spark.co.nz/mobile
7. Legacy Blackberry devices (Model numbers 9xxx) are not compatible with Spark Mobile plans. Blackberry devices running Blackberry OS 10 or above, starting with the Z10, can be connected to Spark Mobile plans.
8. Managed Mobility minimum connection volumes and on-boarding fees may apply.
9. Spark terms, conditions and charges apply. On 24 month plans early termination charges and/or repayment of some of the mobile subsidy may apply if your fixed term contract ends early. Additional charges apply once you use up your included amounts.
10. Unlimited talk for standard person to person calls to standard New Zealand and Australian numbers. Excludes premium and special numbers. Unlimited talk cannot be used for multiple simultaneous calling, re-supply, call centre usage, telemarketing, application-to- person communication, continuously call forwarding, auto-dialling, machine to machine communication (including by using your SIM card in any other device), Cellular Trunking Units (CTUs), or any other activity that Spark considers to be non-standard personal usage.
11. Unlimited text for standard person to person texts to standard New Zealand and Australian numbers. Excludes premium and special numbers. Unlimited text cannot be used for re-supply, call centre usage, telemarketing, bulk messaging, application-to-person communication, machine to machine communication (including by using your SIM card in any other device), Cellular Trunking Units (CTUs), or any other activity that Spark considers to be non-standard personal usage.
12. If you are receiving Unlimited Minutes and/or Texts the following Fair Use policy applies: Unlimited Minutes and/or Texts is only available for national person to person call or texts to standard NZ or Australia numbers (not special chargeable numbers). If in Spark's reasonable opinion your usage is excessive or unreasonable Spark reserves the right to request that you and the other users/ sharers on your account, reduce your usage and, in the event of continued excessive and/or unreasonable use Spark reserves the right to charge you the relevant overage fee or migrate you and/or some of the other mobiles on your account to an alternative plan for the remaining term of your contract.
13. When travelling overseas additional voice and data roaming charges apply.
14. Ultra Business plans are only available to Spark Business and Spark Digital customers.

When you buy a new mobile device with a one-off charge of $173.04+GST or higher – and after any applicable subsidy or Pool of Funds has been applied – you can choose to pay for it on your Spark account and spread the cost over 12 or 24 months, with no interest charged.
